Terms of Service

These Terms of Service (“Terms”) govern your access to and use of SMARTICKS (smarticks.in), including all related websites, dashboards, practice tools, grading features, chatrooms, resource libraries, and any content or services made available through the platform (collectively, the “Service”).

By creating an account, submitting payment proof, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not register for or use the Service.

SMARTICKS is intended primarily for Delhi University students and related academic practice. You represent that the information you provide during registration is accurate and that you are using the Service for lawful educational purposes.

You must provide a valid email address, password, phone number, semester, college name, and payment proof as requested during sign-up. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Accounts remain subject to manual verification and approval before full access is granted. SMARTICKS may approve, reject, suspend, or revoke access at its sole discretion where payment proof is invalid, incomplete, duplicated, fraudulent, or otherwise unsatisfactory.

You agree to notify us promptly if you suspect unauthorized access to your account. We are not liable for losses arising from your failure to safeguard your credentials.

The Service provides interactive examination practice using previous-year question papers, timed mock sessions, answer submission workflows, progress tracking, rankings, notes-sharing links, chat features, and related educational tools.

Features may vary by course, device, browser, approval status, maintenance mode, credit availability, or platform updates. SMARTICKS may add, modify, limit, or discontinue any feature without prior notice.

Intelligent subjective evaluation and automated scoring are provided on a best-effort basis. Results are indicative practice feedback and do not constitute official university marks, guarantees of examination performance, or academic certification.

Access to the Service may require a one-time early-access payment (currently ₹99 unless otherwise stated on the website). Pricing, promotional offers, and future subscription models may change at any time for new users.

Payment is completed outside the platform through UPI or other methods displayed at registration. You must upload valid payment proof in the format and size limits specified on the sign-up form.

Approval of your account does not occur automatically upon upload. Verification may take time. You must not attempt to circumvent payment, reuse another user’s proof, or misrepresent payment status.

You agree not to misuse the Service, including by sharing account access, scraping content, attempting to reverse engineer platform systems, uploading malware, harassing other users, posting unlawful content in chatrooms, or interfering with fair-attempt rankings or grading workflows.

You must use the platform honestly for personal academic practice. Attempts to manipulate rankings, abuse grading credits, evade timers, or impersonate other students are prohibited.

We may monitor usage for security, moderation, fraud prevention, and service improvement. Automated systems and human review may be used for these purposes.

You may submit user-generated content through features such as chat messages, notes-sharing links, answer uploads, and contact forms. You retain responsibility for everything you post or upload.

By submitting content, you grant SMARTICKS a limited licence to store, display, moderate, and process that content solely to operate the Service. You represent that you have the right to share what you submit.

Do not post personal information of others without consent, spam, hate speech, threats, exam misconduct instructions, or material that violates university rules or applicable law.

SMARTICKS may remove or restrict user-generated content at any time where it violates these Terms or creates risk for users or the platform.

SMARTICKS reserves the right to moderate chatrooms, notes-sharing entries, flagged submissions, and other user content using automated filters, admin review, and user reports.

Administrators may issue warnings, remove content, revoke feature access, suspend accounts, or permanently ban users for violations. A repeated-warning policy may apply, including account removal after multiple confirmed violations.

Moderation decisions are made to protect the community and integrity of exam practice. We are not obligated to pre-screen all content and are not liable for user posts you encounter before removal.

If you believe content violates these Terms, use available reporting tools or contact us. We may act at our discretion and are not required to provide detailed explanations for every moderation action.

The SMARTICKS name, branding, software, interface design, and original platform content are owned by or licensed to SMARTICKS and protected by applicable intellectual property laws.

You must not upload, link to, or share copyrighted materials — including scanned books, paid notes, proprietary question banks, or pirated PDFs — unless you own the rights or have explicit permission from the copyright holder.

Examination papers and third-party resources made available through the Service may remain the property of their respective owners. Your use is limited to personal academic practice as permitted by the platform.

You may not copy, redistribute, resell, or commercially exploit the Service or its contents except where expressly allowed. Repeat copyright violations may result in immediate account termination.

All fees displayed at the time of registration are due in full before access is considered. Chargebacks, disputed UPI transfers, or reversed payments may result in immediate suspension pending investigation.

Because access involves digital provisioning that begins upon approval, pricing reflects immediate delivery of platform features, server costs, and ongoing content maintenance rather than a physical returnable product.

Promotional early-access pricing is offered on a limited basis and may not be combined with other offers unless explicitly stated on the website.

Where permitted by applicable law, requests for fee adjustments must be submitted in writing through the contact page within seven (7) days of payment and before substantial use of graded submissions, downloaded materials, or premium dashboard features.

Except where mandatory consumer protection law requires otherwise, all payments made for SMARTICKS access are final and non-refundable. This includes cases of accidental purchase, change of mind, unused accounts, partial use of the platform, dissatisfaction with mock scores, device incompatibility, internet connectivity issues, or failure to complete examinations at university.

NO REFUND will be issued once payment proof has been accepted and/or your account has been approved, regardless of whether you continue to use the Service, whether features meet your expectations, or whether your academic results improve.

Administrative rejection of an account before approval does not automatically entitle you to a refund if the rejection resulted from invalid, duplicate, or fraudulent payment proof supplied by you.

Certain features, including intelligent subjective evaluation on desktop, may consume daily or granted credits as described on the dashboard. Credit rules, reset times (including IST midnight resets), and grant policies may change.

Mobile read-only practice and offline completion flows may not consume credits where stated, but availability is not guaranteed for every paper or course.

SMARTICKS does not guarantee uninterrupted grading capacity, ranking accuracy, or availability of any specific paper, course category, or examination year.

Leaderboards and progress charts reflect platform activity only. Rankings may exclude incomplete attempts, unfair attempts, or administratively flagged sessions as described in product rules.

Notes-sharing, eResources libraries, and other features may link to third-party websites, Google Drive folders, YouTube videos, or files hosted outside SMARTICKS.

SMARTICKS does not control, endorse, or verify external resources. We are not responsible for their accuracy, safety, availability, malware risk, privacy practices, or copyright status.

You access external links and third-party materials at your own risk. Verify content independently before relying on it for examinations or sharing it further.

We collect and process registration details, usage data, uploaded payment screenshots, submitted answers, chat content, and technical logs as needed to operate, secure, and improve the Service.

Payment screenshots are stored securely and reviewed only for verification purposes. Do not upload images containing unrelated sensitive information where avoidable.

We may retain certain records after account closure where required for fraud prevention, dispute resolution, or legal compliance.

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

SMARTICKS does not guarantee specific marks, ranks, admissions outcomes, employment outcomes, or examination success. Practice results are informational only.

We do not warrant that the Service will be error-free, uninterrupted, secure, or free of harmful components.

To the fullest extent permitted by law, SMARTICKS and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or academic opportunity arising from your use of the Service.

Our total aggregate liability for any claim relating to the Service shall not exceed the amount you paid for early access in the twelve (12) months preceding the claim.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the minimum extent permitted by law.

We may suspend or terminate your access immediately for breach of these Terms, suspected fraud, abusive behaviour, security concerns, or operational necessity.

You may stop using the Service at any time, but termination does not entitle you to a refund of amounts already paid except where required by mandatory law.

Provisions that by their nature should survive termination — including payment, refund, intellectual property, disclaimer, and limitation of liability clauses — will continue to apply.

We may update these Terms from time to time. The “Last updated” date at the top of this page indicates the latest revision.

Material changes may be communicated through the website, dashboard notices, or email where appropriate. Continued use after changes become effective constitutes acceptance of the revised Terms.

If you do not agree to updated Terms, you must discontinue use of the Service.

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts located in Delhi shall have exclusive jurisdiction over disputes arising from or relating to the Service, subject to applicable consumer protection rules.
